What is a Special Needs Trust Account in regards to my Workers' Compensation case?

A:
Basically, a special Needs Trust is an account that is designed for an injured worker to be able to use the funds for his or her benefit, such as for the cost of future medical care you may have resulting from your workers’ compensation injury. It is set up so that the funds in that account will not affect other state or federal benefits (such as social security disability, for example) that an individual may be receiving. There can be pro’s and con’s to setting this up depending on your unique case, so it is always a good idea to discuss this at length with your attorney well before settling your workers’ compensation case or establishing the Special Need Trust account on your own.
