Yes, you are allowed to bring either your spouse or one family member or friend to your appeal. Having the support of someone close during the hearing is tremendously important for many of our clients.

However, keep in mind:

  • Testimony given by a family member or friend is typically given less consideration than your testimony and the information in your claim file. Most Administrative Law Judges assume that the people closest to you have bias.
  • If you have an attorney, tell them now. They may want to meet with your wife first.
  • It’s important for you to answer the questions the ALJ asks without assistance. Even if you can’t remember an answer or seem to need help, your wife shouldn’t try to intervene during your interview.
  • Anyone who attends your hearing with you will need to make a good impression on the ALJ. Have your wife review our blog article with pointers for hearing day with regard to appropriate dress and how to act on the facility grounds.
  • In some situations, you’re going to need to make some difficult decisions. If you ever have any concern that someone you’d like to bring with you to an appeal hearing might damage the impression you make, it might be better to choose someone else or just go with your attorney.
