Understanding the Income You Receive While Out of Work (Temporary Disability)

One type of income you can be paid income while out of work due to an industrial injury, is Temporary Disability.

Temporary Disability:

Temporary Partial Disability (TPD) is paid if temporarily, you cannot your perform your full job duties, buy you can perform some job duties on a modified basis or with work restrictions.  Your treating physician will be the one who decides what those restrictions are, and as a result decides whether you are TPD or TTD.

Temporary Total Disability (TTD) is paid if temporarily, you cannot perform your job duties at all.  Your treating physician is usually the one who decides your ability to return to work and therefore whether or not you have reached TTD status.  If the carrier disagrees or if we disagree there are avenues to dispute this.  

TTD is paid at two-thirds of your salary (subject to maximums).  TPD is paid at two-thirds your weekly loss in wages, as you will be performing some work and receiving payment from your employer under TPD.  Temporary Disability, both TTD and TPD, is paid for no more than two years as a general rule.  There are exceptions and limitations depending on your date of injury but for the majority seeking assistance at this juncture, it is two years.

There can be issues with receiving Temporary Disability, believe it or not the insurance company doesn’t always pay you what you’re owed or when you’re doctor says you’re temporarily disabled.  If the insurance company denies your case you may be without income for some time, and there are ways to fight that but you need to know what you’re doing so you can minimize your time without income.  Our office can help with you with all these things and keep the income coming in so you can keep a roof over your head!
