How Arnold & Jerry Messed With Your Comp Benefits

SB-863 and SB-899 resulted in the most massive change in how benefits are dolled out in the California Workers’ Compensation system in a hundred years. In 2012, thanks to Jerry Brown, and a business controlled legislature, the power to protect injured workers’ medical treatment rights was hijacked by “Independent Medical Review” (IMR). IMR takes from an injured worker the reason and logic of making thoughtful medical treatment decisions. Now physicians, who will never see an injured worker, get to decide important medical treatment issues. Unfortunately, there is no meaningful right to an appeal an erroneous decision! The process is a flagrant denial of due process and I predict it will be found unconstitutional.

SB-899 was an entirely different story. In 2004, thanks to Arnold Schwarzenegger, and an earlier business controlled legislature, basic rights to benefits in the Workers’ Compensation system were slashed to the bone. No one really benefited from this but the insurance companies and the businesses they insured.
