Whether you have been awarded temporary or permanent disability, California workers’ compensation law is currently designed to encourage employers to return injured employees to the payroll as soon as it is safe to do so.

There are different types of jobs you may be offered, depending on the nature of your injury and your current status in the workers’ compensation system.

Regular Work

The same job you had before your injury, which must:

  • Last at least 12 months.
  • Offer the same benefits and compensation you were receiving at the time of your injury.
  • Be located within a reasonable commute of your residence at the time of your injury.

Modified Work

The same job you had before your injury, modified in a way that allows you to safely perform necessary tasks, which must:

  • Meet your medical restrictions.
  • Last a minimum of 12 months.
  • Offer at least 85% of the benefits and compensation you received at the time of your injury.
  • Be located within a reasonable commute of your residence at the time of your injury.

Alternative Work

An entirely different job with your employer, which must:

  • Respect your work restrictions.
  • Meet same requirements for length, compensation, and location as modified work.
